Terms of Service

By creating an account or using any part of the SocialBeat platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

You must be at least 13 years of age to use SocialBeat. By using the Service you represent that:

• You are at least 13 years old.
• You have the legal capacity to enter into a binding agreement.
• Your use of the Service does not violate any applicable law or regulation.

You must provide accurate and complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@socialbeat.app if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

SocialBeat offers paid subscription plans billed on a monthly or annual basis.

• Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on the applicable billing cycle.
• Subscription fees are non-refundable except where required by applicable law.
• Upgrading a plan takes effect immediately. Downgrading takes effect at the start of the next billing cycle.
• We reserve the right to change pricing with at least 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
• Failure to pay may result in suspension or termination of your account.

You agree not to use SocialBeat to:

• Post content that is illegal, harmful, defamatory, harassing, or infringes on any third-party rights.
• Spam or send unsolicited messages through connected social accounts.
• Attempt to gain unauthorised access to any system, account, or data.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated scripts or bots to interact with the Service in a way that causes disruption.
• Violate the terms of service of any connected social media platform (Instagram, Threads, LinkedIn, X).

You retain ownership of all content (captions, images, videos) you create or upload to SocialBeat. By using the Service, you grant us a limited, non-exclusive licence to store and process your content solely to provide the Service.

SocialBeat, its logo, UI, and underlying technology are the intellectual property of Nimap Infotech. You may not copy, modify, or distribute any part of the Service without our prior written consent.

SocialBeat publishes content to third-party social media platforms on your behalf. You are solely responsible for ensuring your content and usage comply with the terms and community guidelines of each platform:

• Meta Platform Terms (Instagram & Threads)
• LinkedIn User Agreement
• X (Twitter) Terms of Service

SocialBeat is not responsible for any action taken by a social media platform against your account, including suspension or content removal.

SocialBeat may use artificial intelligence to help you generate captions and content suggestions. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, or inappropriate — always review before publishing.
• You are solely responsible for any content published through your account, including AI-assisted content.
• We do not warrant that AI-generated content is original or free of third-party rights.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIMAP INFOTECH AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You may cancel your account at any time from the profile page. Upon cancellation, your subscription will remain active until the end of the current billing period.

We may suspend or terminate your account immediately, without notice, if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Italy.
